Under Part VIIC of the Immigration Ordinance, Cap. 115

Torture or cruel, inhuman, degrading treatment or punishment as set out in Article 3 of the Hong Kong Bill of Rights

Persecution

Under Article 33 of the 1951 Convention relating to the Status of Refugees

Right to Life

As set out in Article 2 of the Hong Kong Bill of Rights (since 12 September 2016)

Scope of Legal Assistance

Advise the claimant of legal rights and procedures

Assist to complete and submit the non-refoulement claim form

Accompany claimant to screening interviews if necessary

Assess merits of appeal and/or petition for rejected claims

Prepare submissions for meritorious appeal/petition cases

Represent claimant at appeal oral hearing

Assist in making requests to re-open claims or make subsequent claims

Prepare submissions for objection notices on revocation

Completely Free of Charge

All claimants applying for legal assistance must make a statutory declaration that they are without means to pay the cost of legal representation. This service is completely free.
